Services and Refund Policy
What I deliver, what I don’t, and what happens if something goes wrong.
Cami Marketera offers marketing consulting: judgment, analysis and recommendations. This page sets out what is delivered, what is not, how far liability extends, and when a refund applies.
Payment and delivery
Payment is made in full before the service begins. There are no sessions and no access to materials until payment is confirmed.
Payment is accepted through PayPal.
Prices are in US dollars unless another currency is agreed in writing. Payment platform fees and currency conversion differences are the client’s responsibility.
Nature of the service
Cami Marketera offers strategic consulting: analysis, judgment and recommendations grounded in professional experience.
What it includes
- Analysis of the business and its current strategy
- Recommendations, plans and frameworks tailored to the case
- Working sessions and support, according to the package purchased
- Access to proprietary tools, audio and resources
What it does not include
- Execution of marketing tasks. That is agency work, not consulting
- Any guarantee of results, sales or specific metrics
- Automatic achievement of objectives
- Legal, accounting, tax, financial or medical advice
The client’s responsibility
Results depend on implementation. Consulting provides the map; the client walks the road.
For the work to succeed, the client:
- Understands the plan and the agreed strategy
- Follows the recommendations provided
- Executes the agreed steps within the agreed timeframes
- Does the work on their side: research, creation, testing and iteration
- Provides, on time, the information and access the work requires
If the client does not implement, the objectives are not met. That is the client’s responsibility, not the service’s.
The client is also responsible for the accuracy of the information they provide, and for ensuring their business, products and communications comply with the regulations that apply to them.
Limitation of liability
Cami Marketera contributes judgment, analysis and recommendations. Business decisions, their execution and their outcomes belong to the client.
The cap. To the fullest extent permitted by applicable law, Cami Marketera’s total liability to the client for any claim arising out of or relating to this service — regardless of its cause, and whether brought in contract, tort or on any other basis — shall in no event exceed the amount the client actually paid for the service in question.
In plain terms: in the worst case, the most that can be returned is what was paid. Nothing beyond that.
What is not compensated. Cami Marketera is not liable for lost profits, lost revenue, lost business opportunities, loss or corruption of data, reputational harm, or any indirect, incidental, special or consequential damages, even if advised of their possibility.
Outside anyone’s control. Nor is Cami Marketera liable for market shifts, changes to third-party platforms, algorithms, policies or pricing, acts of authority, supplier or connectivity failures, or decisions the client makes departing from what was recommended.
What Cami Marketera is responsible for. Delivering the consulting honestly, expertly and in a tailored way; honouring the agreed sessions and timeframes; and applying professional experience and judgment.
Carve-out. Nothing in this section limits or excludes liability that applicable law does not permit to be limited or excluded, including liability arising from willful misconduct or gross negligence.
Refund policy
Where a refund applies, only the amount paid is returned: no interest, no additional charges, no compensation of any other kind.
When a refund applies
- The service was not delivered as agreed for reasons attributable to Cami Marketera: cancellation on her side, inability to deliver, or a technical failure preventing delivery
- The client withdraws before the first session, within 30 calendar days of payment
When it does not apply
- After the first session has taken place: from that point the service is under way
- Dissatisfaction with the results obtained
- Failure to implement the recommendations
- Having already accessed the materials, audio or deliverables
- Repeated non-attendance or abandonment of the process by the client
How it is processed. Requests are made in writing to the contact email. Refunds are returned through the original payment method within 7 to 10 business days of approval.
Where the consumer protection law of the client’s country grants a broader right of withdrawal, that right prevails over this section.
Conditional guarantee
Some packages include this guarantee: if at 90 days the client is not where it was agreed they would be, the fourth month is on Cami Marketera.
The guarantee applies only if the client:
- Completed every scheduled session
- Followed the recommendations provided
- Implemented the plan as agreed
- Did the work on their side
It does not apply if the client did not implement the plan, abandoned the process partway, or where the obstacle was one of execution — lack of time, lack of resources, or internal changes not communicated in time.
The objective measured at 90 days is put in writing at the start of the process. If it was not put in writing, there is no objective to measure and the guarantee does not apply.
The guarantee is satisfied by the additional month of service. It does not convert into a refund.
Scheduling, cancellations and validity
Rescheduling. This depends on the package:
- The Snapshot of Your Business: both sessions are set at purchase and are not moved once agreed. It is a short package and its value lies in the two sessions happening close together.
- Minimum Viable Marketing System and Premium: the client may move up to two sessions per package, giving at least 24 hours’ notice, at no cost.
Non-attendance. If the client does not attend and has not given 24 hours’ notice, the session is considered delivered and is deducted from the package.
Validity. The sessions in a package are scheduled and held within 90 calendar days of payment. After that period they expire, unless otherwise agreed in writing.
Credit between packages. Where a client purchases The Snapshot of Your Business and decides to continue with the Minimum Viable Marketing System, the amount paid for the Snapshot is credited against the price of the System. That credit is valid for 30 calendar days from the Snapshot’s second session, cannot be combined with other promotions, and is not redeemable for cash.
Cancellation by Cami Marketera. If a session cannot take place for reasons on her side, it is rescheduled at no cost. If the full service cannot be delivered, the refund terms in section 05 apply.
Recording, confidentiality and data
Recording. Sessions may be recorded to produce the summary the client receives, for internal documentation, and to improve the service. By scheduling, the client consents to this recording. Anyone who prefers not to be recorded says so before the session and an alternative is arranged.
Confidentiality. Business information shared by the client is confidential and is not disclosed without their express consent.
Case studies. Insights from sessions may be used anonymously, without any name, brand or detail that could identify the client. Using a client’s name or logo requires their written authorization.
Personal data. Data is processed to deliver the service, issue invoices and maintain communication. It is not sold or transferred to third parties for commercial purposes. Clients may request access to, correction of, or deletion of their data by writing to the contact email, and will receive a response within 30 days.
Ownership of deliverables
What belongs to the client. The diagnosis, the plan and the documents produced specifically for their business are theirs. They may execute them on their own, with their team, or with anyone they choose, even if they decide not to continue the process.
What remains Cami Marketera’s. The Minimum Viable Marketing methodology, together with its frameworks, templates, tools and training materials, is the property of Cami Marketera. The client receives an indefinite licence to use them internally, within their own business.
What is not permitted. Reselling, redistributing, publishing or teaching those materials to third parties, or presenting them as one’s own, without written authorization.
Governing law
This agreement is governed by the laws of the Province of Ontario, Canada, and the laws of Canada applicable therein. Any dispute is submitted to the courts of competent jurisdiction in Ontario.
This does not affect any rights that the consumer protection law of the client’s country of residence grants them on a mandatory basis. Where that law grants the client something more favourable, it prevails over what is stated here.
Before formal proceedings. The parties undertake to attempt to resolve any difference in good faith and in writing, within 15 days of one party raising it with the other.
If a clause fails. If any provision of this policy is found invalid or unenforceable in a given jurisdiction, the remaining provisions stay in force, and that provision is interpreted to the fullest extent that jurisdiction’s law does permit.
Acceptance
These terms are accepted before payment, in two ways: by replying in writing to the proposal received, and by paying the PayPal invoice, which links to them in its notes field.
Anyone with questions about any point writes before paying and it gets clarified.
Cami Marketera may update this policy. The version in force is the one published on this page, with its last-updated date. Each engagement is governed by the version in force at the time of payment.
Better to ask before you pay
If there’s a point in this policy you’re not comfortable with, write to me and let’s talk it through. I’d rather sort it out now than later.
